Speak Out for Public Transportation and Jobs at MTA on Saturday

The first of two public meetings that may decide the fate of lines 190 and 194, will be held tomorrow at MTA headquarters in Downtown LA.  This meeting, which is described as a regional meeting, will take public comment and testimony on all of the proposed services changes regardless of the region.   The meeting details are below.

General Chairman Meets with LA Mayor to Discuss Service Changes and Tax Measures

SMART Transportation Division General Chairman Marco Gudino met with Los Angeles Mayor Eric Garcetti at City Hall on Tuesday, February 2, to discuss concerns over MTA's proposed service changes and the proposed tax measure likely to appear on the November 2016 ballot.

Leaders from SMART General Committee 875 have had a number of meetings with elected officials over the past 2 months about the proposed service changes, specifically the elimination of lines 190 and 194.  The message in every one of these meetings has been clear.  These service changes are bad for public transportation, bad for the MTA, and bad for middle class jobs in LA County.  Mayor Garcetti was very helpful the last time these lines were first put up for elimination in December 2014 while he served as the LACMTA Board Chairman.  Now that he is no longer the Chairman, Mayor Garcetti could make no promises as to the fate of lines 190 and 194. 

Mayor Garcetti was very sympathetic and responsive to the message delivered by General Chairman Marco Gudino, but advised that the recommendation from the MTA San Gabriel Valley Service Council will carry the greatest influence with the MTA Board. 

"The Mayor has told us that the local communities of LA County get a very big say on the transportation services they receive in their area," said Gudino.  "That's why it is so important for our members to show up to the public meetings this month and convince the service council to keep these lines.  Its good for public transportation and its good for middle class jobs in their communities."

The Mayor did say he would try to talk with some of the other MTA Board members to see what, if anything, could be done about lines 190 and 194.

Also on the agenda was a new transportation tax measure that is planned to appear on the November 2016 ballot.  Currently nicknamed "Measure R2", will extend the current Measure R half cent sales tax and place an additional half cent sales tax on top of it.  The new tax measure is estimated to raise $120 billion for transportation projects over the life of the measure. 

Unlike the previous Measure R, no money had been set aside for public transportation operations' budgets in the bill sent from Sacramento that allows the MTA to put the tax measure on the ballot.  Without money for operations in the measure, there would be no mandate to the board to use this money to provide for the services.  The General Committee and State Legislative Board have lobbied from the beginning of the process for a minimum of 25% of the new tax measure be set aside for operations, just as it was with Measure R.  Without the 25%, the message from SMART and General Chairman Marco Gudino was that there would be no support for the measure from the bus and rail operators.  Needing 2/3 majority to pass, the tax measure will need all the help and support it can get.

Yesterday, Mayor Garcetti gave General Chairman Gudino the assurance that there would be money for operations in the tax measure that goes to the voters.  The General Committee should get its first look at the language that will appear in the measure in the coming weeks.  The LACMTA is currently drafting the language and the MTA Board will need to vote and approve it soon if it is to be ready for November.

Local 1563 Member Anthony Williams Honored for Protecting MTA Bus Passengers

SMART Transportation Local 1563 member and LA Metro Bus operator Anthony Williams was honored at the LACMTA General Board Meeting yesterday for his actions in protecting passengers on his bus route.

While operating on Line 105, Mr. Williams was notified by a passenger that there was a man asleep with a gun in the back of the bus.  Upon confirming the information for himself, he calmly stopped at the next available stop and ushered passengers off the bus.  He then notified law enforcement who arrived shortly afterwards to take the man away without incident.  Mr. Williams was invited to the January LACMTA General Board Meeting at 1 Gateway Plaza to be recognized and honored for his actions.

"I was just doing my job," said Williams. "I wasn't expecting all this."

Local 1563 Chairman Robert Gonzalez was on hand to help congratulate and honor Anthony Williams for his actions.

General Committee to Fight Proposed Service Changes

Dear Brothers and Sisters,

The LACMTA is once again proposing a number of service changes that include the elimination of bus lines.  Bus Lines 190 and 194 out of Division 9 are included in the changes and set to be turned over to Foothill Transit.  This elimination was originally proposed in December 2014. Through our advocacy and efforts last year, we thought we had settled the matter and protected these lines.  MTA staff came back to us again this year to let us know that these lines were back on the table for elimination.  This month we have already scheduled meetings with LA Mayor Eric Garcetti, LA County Supervisors, MTA Board members and the LA County Federation of Labor.  Our message to everyone is the same and is clear.  The elimination of these lines is bad for LA County, bad for the MTA, bad for MTA employees and is in our opinion, a violation of our contract.  We will do everything in our power to protect these lines and the work of our members.

The San Gabriel Valley Service Council will make a recommendation on the fate of these lines to the full MTA Board following their February meeting.  We are asking all SMART Transportation members who are able, to attend and give testimony in opposition to the elimination of these lines.  The meeting details are below:

Electric Bus Maker Accused of Violating Agreements

Electric Bus manufacturer BYD Motors, who has contracts with LA Metro and Long Beach Transit, has been accused of violating contract agreement with the transit agencies, the public and the tax payers of Los Angeles County.  The alleged violations include failing to meet the living wage ordnance, creating an unsafe and hostile work environment, and outsourcing jobs earmarked for low income Los Angeles residents to overseas manufacturers in China. 

Jobs to Move America will be holding a press conference and demonstration in front of BYD Motors headquarters (1800 S Figueroa St, Los Angeles CA 90015) on Tuesday, December 1 from 11AM - 1PM.  The purpose of the press conference is to bring public attention to these alleged violations and to demand that BYD Motors comply with investigations.  You can read a copy of a letter Jobs to Move America has sent to BYD Motors by following the link below.

Nelson Zapata: Transportation Employee of the Month

The General Committee of Adjustment 875 and Local 1607 would like to congratulate Nelson Zapata from Division 10 for being named LACMTA's Transportation Employee of the Month.  He was honored today at Metro's System Safety, Security and Operations Committee Meeting held in the Metro Board Room at One Gateway Plaza.

Nelson Zapata is a 14 year bus operations veteran for LA Metro.  He serves on the Accident Reduction Tactics and Strategy Team, as well as a Line Captain and Line Instructor at Division 10.  On top of the additional duties he takes on, Nelson has represented his fellow bus operators at every Bus Rodeo since being hired. On one such occasion, he came 5 points short of a perfect score during a preliminary event.

"I am so proud of the work he is doing," said Local 1607 Chairman Gilbert Camacho who was on hand to help recognize Nelson. "He is a good operator, a good person and he is very deserving of this honor."

875 Hosts Training to Prepare for Cases and Negotiations

SMART Transportation representatives met at General Committee 875 offices yesterday for the second in a series of classes designed to improve discipline case handling and negotiation skills.  The classes were timely given the over 150 cases General Committee 875 representatives were dealing with this week.  The staggering number and backlog of discipline cases is a top priority for General Chairman Marco Gudino and this weeks efforts are a major step forward in dealing with the issue.

While the General Committee practices, trains and takes classes to better represent their members, they would like to remind the members of some very important rules and rights that employees have in the event of potential discipline.  Weingarten Rights guarantee an employee the right to Union representation during an investigatory interview that may result in discipline.  These rights, which are guaranteed by a 1975 US Supreme Court decision, dictate a number of rules to the employer and employee and they are as follows.

Rule #1 - The employee must make a clear request for Union representation before or during the interview.  The employee can't be punished for making this request.  The employer is under no obligation to advise an employee of this right.

Rule #2 - After the employee has made a request for Union representation, the employer has 3 options.

            1)         Grant the request and delay the interview until the Union representatives                                                      arrives and has had a chance to consult with the employee.

            2)         Deny the request and end the interview.

            3)         Give the employee the choice to continue the interview without Union                                  representation or ending the interview.

Rule #3 - If the employer denies the request and continues to ask questions, the employee has the right to refuse to answer.  The employee cannot be disciplined for the refusal but is required to remain at the interview until the interview is ended by the employer.  Leaving before the end of the interview can be punished as insubordination.

The key to these rules are to remain calm and simply ask for Union representation in the case of potential discipline.  A quick meeting with a Union representative could make all the difference in the world.

The General Committee has been informed that many of the members have been mistakenly calling the SMART Transportation Division offices in Cleveland to ask questions about the Healthcare open enrollment.  The Cleveland office does not administer or manage the health plans and will have no information to answer those questions.

Bus Operator Assailant Gets 9 Years

Geovanny Falcon, the man accused of assault on a MTA bus operator in November 2014, has been sentenced to 9 years in state prison.

Geovanny Falcon was arrested on November 27, 2014 for the brutal assault of MTA Bus Operator and Local 1565 Member Deborah Carroll.  The assault occurred on the night of November 17, 2014 and was caught on an internal security camera that allowed law enforcement to identify Mr. Falcon.  Ten days later, an acquaintance of Falcon's notified law enforcement of his whereabouts and he was arrested later that morning.

Assistant District Attorney Elizabeth Dickinson notified the General Committee this week of the final result of the case.  Mr. Falcon plead guilty to the battery of a bus operator and received 5 years.  At the time of his arrest, Falcon was on probation for three other crimes which in part lead to the length of the process.  All together Geovanny Falcon was sentenced to 9 year in California State Prison.

"I was very happy to hear the news", said General Chairman Marco Gudino.  "Its great to know this guy will be off the streets for a long time."

After receiving the news from the Assistant District Attorney, General Chairman Gudino called Deborah Carroll to give her the good news.  Carroll was contacted by the DA's office a few months ago and notified that this would be the eventual outcome, but she was happy and relieved to hear that justice has finally been served.

In response to this assault, the LACMTA has pushed ahead with a number of safety initiatives.  First is the new 2 part protective barrier system many operators may already be seeing.  Expedited procurement of this safety enhancement has been approved and operators will start to see more of them on their buses in the near future.  The MTA Board is also reviewing their policing procedures and contracts. The General Committee has endorsed a plan that would increase the police authority of the Transit Security Officers so that there can be a greater security presence throughout the system.  Finally SMART TD is following legislation in Sacramento that would increase the penalty for assaults on public transportation workers.

New MTA Staff, New Challenges, New Opportunities

Dear Brothers and Sisters,

Summer has come to an end and Fall is upon us, even if the weather has not gotten the message.  The change in the season brings many changes to the MTA and new business from the MTA Board.  Those changes have brought new challenges but also new opportunities for this General Committee and our members.

CEO Phil Washington has predictably brought in his own management team to help him lead the agency.  He made changes in staff from Public Relations to Operations and even created the new position of Chief Innovation Officer that we are following closely.  This General Committee had a chance to meet with the new head of Operations Jim Gallagher earlier in September. He is a strait forward, get things done kind of guy and he seemed very eager to clean up many of the issues we have been dealing with.

One of the issues that I am very concerned about is the backlog of cases at Third Level and arbitration.  Your General Committee has been scheduling arbitrations and pre arbitration and I have been working with Labor Relations to address the issues that are leading to the backlog.  We are starting to see some positive changes but there is a lot more work left to be done.  I will continue to be vigilant and use the tools in Article 27 to bring about swift and positive decisions for our members.

As many of you know, I have been traveling around to the divisions to meet with our members.  Although I have not had a chance to visit all of the divisions yet, I have noticed a positive change to morale in the places I have been.  I believe that changes to the discipline rules have changed the relationship between management and labor for the better.  I am committed to continuing this trend of increased morale and that why I plan to be a much more visible and accessible General Chairman than my predecessors.  If you see me at your division, please come up, introduce yourself and tell me about your day.

SEPTEMBER MTA BOARD MEETING

This months LACMTA Board Meeting was held on September 24th at the MTA Board Room at One Gateway Plaza.  This was the first full meeting of the Mark Ridley-Thomas era as the MTA chairman.  These are some issue that may concern MTA operators and members of the SMART Transportation Division.

New Management Staff

CEO Phillip Washington introduced new members of the executive management team to the board on Thursday.  The introductions included the new Chief Operations Officer James Gallagher.  Gallagher has had a 35-year transportation career with management experience at Bay Area Rapid Transit (BART) District, Washington Area Transit Authority (Metro) in Washington, D.C., Metropolitan Transit Authority of Harris County (Metro) and most recently at the Transportation Corridor Agencies in Irvine, Calif.  The General Committee met with Mr. Gallagher earlier this month to meet begin the dialogue on issue that impact the operators.  Former Interim COO Bob Holland, with whom General Committee 875 has a strong working relationship, will remain in Operations as Gallagher's #2.

Operator Safety Barriers

At July's MTA Board meeting, CEO Phil Washington requested an expedited procurement process of the operators safety barrier that had previously been approved.  The expedited procurement was approved and will be arriving on the New Flyer buses as well as retrofitted on the existing bus fleet.  General Committee 875 has been generally supportive of this barrier system that finally provides some form of operator protection.  For operators who are uncomfortable with the barrier system, the General Committee is committed to giving operators the option to utilize the glass barrier in the open position as it was designed to do. 

Legislative Agenda

The MTA has been pushing a number of legislative items in Sacramento and many of them have passed in the last session. 

SB 767, dubbed "Measure R2", allows the MTA to put a sales tax initiative on the ballot.  The General Committee has been monitoring this bill closely because of its impact on the future on the operations budget.  This bill, unlike the last Measure R, does not have a guaranteed set aside for operations.  SMART TD, along with the ATU and Teamsters, haS notified the MTA that there will be no union support for a bill that does not provide for operations.  With this tax measure needing a 2/3 vote to pass, this bill will need all the help it can get.

The Orange Line has been a victim of its own success leading to overcrowded buses during the morning and evening commutes.  There are those who mistakenly think that a longer bus will be able to alleviate this issue, so AB 726 changes the maximum bus length allowed on the Orange line from 60 to 82 feet.  SMART TD has been opposing this bill since its inception due to numerous safety and practicality concerns.  The General Committee alternatively has been pushing to make the Orange Line a light rail line as it was originally intended. 

As of now there is no manufacturer for an 82' bus that runs on either CNG or electricity.  There has also been no funding identified to improve the Orange Line to accommodate a bus of that size, so any potential change on this matter is long into the future.  Irregardless of its feasibility, General Committee 875 will continue to oppose this measure as well as offer better solutions to the MTA Board and to the public transportation riders of LA County.  

General Chairman Visits Divisions 5 and 18

General Chairman Marco Gudino visited Divisions 5 and 18 on Thursday, September 3, continuing his tour of the MTA properties represented by GO-875.  Mr. Gudino was accompanied by 1564 Local Chairman Ulysses "Butch" Johnson.  General Chairman Marco Gudino was extremely impressed with the members of Local 1564 as was grateful for his reception by the members in divisions 5 and 18.
